The IRS has put an immediate stop to new ERC claims because of scams that pose an unacceptable risk to businesses. To help protect taxpayers from employee retention credit (ERC) scams, all new ERC claims have been halted until at least January 2024. There has been a surge of questionable claims due to aggressive marketing tactics to ineligible taxpayers. This moratorium also means that processing times will be longer as more scrutiny will be placed on every claim. Businesses should be on the lookout for “wildly aggressive” marketing of misleading or improper ERC claims such as the example below.
